ShiftQ Terms of Service
1. General
These Terms of Service ("Terms") govern your use of ShiftQ, a shift-scheduling, staff-management, and team-communication application ("Service") available at app.shiftq.app.
The Service is provided by a private individual based in Ukraine ("ShiftQ", "we", "us"). The operator's full sole-proprietor (FOP) registration details will be published here before paid plans launch.
By registering for the Service or continuing to use it, you ("Customer", "you") confirm that you have read, understood, and agree to these Terms. If you register an account on behalf of a company or other business, you confirm you have authority to act on its behalf, and "you" refers to that organization going forward.
2. Description of the Service
ShiftQ is a progressive web app (PWA): it runs in a browser and can additionally be installed on a phone or computer without an App Store or Google Play listing. The Service lets a business owner with hourly staff:
- build a shift schedule and manage multiple locations under one account;
- accept shift-swap requests and time-off/leave requests from employees;
- post open shifts that any employee can claim;
- send push notifications about schedule changes.
We may add, change, or discontinue individual features over time, notifying you of material changes as described in Section 11.
3. Registration and account
To use the Service, a business owner creates an organization account and receives a manager role, with the ability to add locations and invite employees by email.
You are responsible for the accuracy of the information provided at registration and for keeping your login credentials confidential. You must notify us promptly if you become aware of unauthorized access to your account.
An individual employee account is intended for use by one person; sharing login credentials among multiple people is not permitted.
4. Free beta, plans, and payment
ShiftQ is currently provided as a free public beta. The Service is free of charge, there is no trial period that expires, and we do not collect payment details. While the beta lasts, nothing is switched off automatically and no functionality is withheld pending payment.
We intend to introduce paid plans later. Before that happens, we will give advance notice and publish here the plan tiers, prices, billing period, currency, refund terms and the name of the payment provider. No organization will be moved onto a paid plan without your explicit consent, and no amount will be charged before you have chosen a plan yourself.
If you choose a paid plan in future: ShiftQ will never store your card details. Payment is processed directly by the payment provider; we receive only a subscription status (active/past due/canceled) and a technical payment reference. You will be able to cancel at any time, and access to paid features will continue through the end of the period already paid for.
5. Customer Data and your responsibilities
As the organization account owner, you enter your employees' data yourself (name, email, phone, optionally a photo). By entering this data you confirm you have a lawful basis to do so (for example, within an employment relationship) and that you have informed your employees that the Service is used to manage their schedule.
With respect to your employees' personal data, you act as the data controller and ShiftQ acts as a data processor operating on your instructions — see our Privacy Policy and Data Processing Addendum (DPA) for details.
You are responsible for the accuracy of the schedule data you enter and for using the Service in compliance with the labor law applicable to your business.
6. Acceptable use
When using the Service, you agree not to:
- enter personal data about individuals without a lawful basis or without their knowledge;
- attempt to gain unauthorized access to another organization's data or bypass technical restrictions of the Service;
- use the Service to send spam, commit fraud, or engage in other unlawful activity;
- copy, decompile, or otherwise reverse-engineer the Service, except where expressly permitted by law.
7. Intellectual property
The software, design, "ShiftQ" trademark, and related documentation belong to ShiftQ. These Terms grant you no rights to them beyond a limited license to use the Service as intended.
Data you enter into the Service (schedules, employee data, etc.) belongs to you. We do not claim ownership of your data and use it solely to provide the Service.
8. Service availability
We aim to keep the Service running reliably but do not guarantee uninterrupted or error-free operation. Short interruptions for maintenance or updates may occur.
The Service is provided "as is," without warranties of any kind, express or implied, including warranties of fitness for a particular purpose.
9. Limitation of liability
To the extent permitted by applicable law, ShiftQ is not liable for indirect, incidental, or consequential damages (including lost profits) arising from use of, or inability to use, the Service.
ShiftQ's total liability for any claim related to the Service is limited to the amount you actually paid for your subscription in the 3 months preceding the claim.
10. Termination
You may stop using the Service at any time by deleting your organization account via Settings → Organization. Deletion is irreversible: all organization data (schedules, employees, history) is deleted from our database after email confirmation and typing the exact organization name.
Before deleting, you can export a full copy of your organization's data as a JSON file from the same settings section.
We may suspend or terminate access to the Service in case of a breach of these Terms, prolonged non-payment, or as required by law, notifying you in advance where possible.
11. Changes to these Terms
We may update these Terms. We will notify you of material changes by email or via an in-Service notice at least 14 days before they take effect. Continuing to use the Service after changes take effect means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of Ukraine. Disputes are resolved through negotiation, and failing that, in the courts of ShiftQ's place of registration, unless mandatory consumer-protection law in your country of residence provides otherwise (in particular, additional protections may apply to consumers in the European Union under local law).
